SECTION 1 - GENERAL
This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from this website (the “Site”).
This Site is operated by MotilityCount ApS (“MotilityCount”, “us”, “our”, “we”) who is the data controller of your personal information. All inquiries to MotilityCount can be made via the contact details listed under section 14.
SECTION 2 – PERSONAL INFORMATION WE COLLECT
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device.
Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, which websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.
We collect Device Information using the following technologies:
- “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.
- “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
- “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Site.
When you purchase something from the Site, as part of the buying process, we collect the personal information you give us such as your name, billing address, shipping address, payment information, phone number and email address. We refer to this information as “Order Information”.
When you send us an e-mail with questions regarding the product or your test result, we receive your name and e-mail address as well as we request a picture of the test result in order to fulfill our customer service in providing an answer. We only store these data as long as necessary and for the purpose of keeping track of consumer questions to improve our product communication.
E-mail marketing and newsletters: With your permission only, we may send you emails about our store, new products and other updates. When you give us your permission we collect your name and e-mail address. The purpose of this is to deliver news to you which could be of your interest.
When we talk about “Personal Information” in this Privacy Policy, we are talking about both Device Information and Order Information.
SECTION 3 - HOW DO WE USE YOUR PERSONAL INFORMATION?
We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:
- Communicate with you;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with
information or advertising relating to our products or services.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).
SECTION 4 - CONSENT
How do you get my consent?
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, contact us by mails, we imply that you consent to us collecting it and using it for that specific reason only.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.
How do I withdraw my consent?
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection of your question or picture of test result, to use or disclosure of your information at any time by contacting us at info@swimcount.com.
SECTION 5 - DISCLOSURE
We may disclose your personal information if we are required by law to do so, or if you violate our Terms of Service.
SECTION 6 - SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as it is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 7 - SHARING YOUR PERSONAL INFORMATION
We share your Personal Information with third parties to help us use your Personal Information, as described above. For example, we use Shopify to power our online store--you can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy.
We also use Google Analytics to help us understand how our customers use the Site -- you can read more about how Google uses your Personal Information here: https://www.google.com/intl/en/policies/privacy/.

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
Information such as your name, address, e-mail, phone number and specific delivery terms will be given to GLS, UPS or another shipping company who are responsible of delivering your purchased goods.
Finally, we may also share your personal information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner of which your personal information will be handled by these providers.
SECTION 8 - BEHAVIOURAL ADVERTISING
As described above, we use your personal information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. DO NOT TRACK
Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.
Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 9 – YOUR RIGHTS
In order to provide transparency regarding the processing of your information, we must inform you about your rights.
If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information in section 14.
Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.
Insight rights
You are entitled at any time to request information about what information we have registered on you, the purpose of the registration, which categories of personal data, who are the recipients of the information as well as from where the information originates.
You are entitled to receive a copy of the personal information we process about you. If you want a copy of your personal information, please send a written request to info@swimcount.com. You will be asked to prove with ID that you are who you say you are to ensure that we do not transfer personal data to the wrong person.
The right to rectification
You are entitled to get incorrect personal information about yourself corrected by us. If you become aware that there are errors in the information we have registered about you, you are encouraged to contact us in writing so that the information can be corrected.
The right to be deleted
In some cases, you have the right to have all or some of your personal information deleted by us, for example, if you revoke your consent and we do not have another legal basis to continue the handling of information. To the extent that continued processing of your information is necessary, for example, to comply with our legal obligations or for legal requirements to be established, enforced or defended, we are not required to delete your personal information.
The right to data portability
You may, in certain cases, have the right to obtain personal information that you have provided us in a structured, commonly used and machine-readable format and have the right to transfer this information to another data controller.
The right to objection
You are entitled at any time to object to our processing of your personal information for direct marketing including the profiling made to target our direct audience.
The right to revoke consent
You have the right to revoke a consent you have given us of personal data, including the profile made by you on our Website. If you wish to revoke your consent, please contact us at info@swimcount.com
SECTION 10 - DELETING PERSONAL DATA
MotilityCount only stores personal data as long as necessary for the purposes stated above. You can also delete your cookies in your browser at any time, or alternatively use Chromes incognito mode if you do not want to accept our cookies.
When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.
Information collected in connection with your registration for our newsletter will be deleted when your consent for a newsletter is withdrawn unless we have another basis for processing the information.
SECTION 11 - SECURITY
To protect your personal information, we take reasonable precautions and follow the industry’s best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
SECTION 12 - COOKIES
Here is a list of cookies that we use. We’ve listed them here so you that you can choose if you want to opt-out of cookies or not.
_session_id, unique token, sessional, Allows Shopify to store information about your session (referrer, landing page, etc).
_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.
cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
_secure_session_id, unique token, sessional
storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.
PREF, persistent for a very short period, Set by Google and tracks who visits the store and from where
SECTION 13 - CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
